Terms of Use

These terms govern your use of magmahq.ai, operated by Magma (in formation). By using the site you agree to them. If you do not agree, please do not use the site.

The site is informational

The site describes what Magma does and lets you express interest. Nothing on the site is an offer, a binding commitment, a guarantee of any outcome, or legal, financial, or investment advice.

No agreement is formed by using the form

Submitting the listing form is informational and creates no agreement or obligation for either party. Any engagement to evaluate, prepare, clean, de-identify, IP-clear, or sell data assets will be governed by a separate written definitive agreement signed by both parties. Until that agreement is signed, neither party is obligated to proceed.

Your submissions and authority

You represent that you are authorized to share what you submit and to discuss the assets you describe. Share only high-level, non-sensitive descriptions through the site, and do not submit raw personal, patient, customer, payment, or credential data here.

Confidentiality

We treat what you submit as confidential and use it only to evaluate a possible engagement. If we proceed, the parties may enter a mutual confidentiality agreement with customary terms.

Regulated data

Where assets include regulated data, for example data protected under HIPAA or data subject to original privacy policies, any handling or transfer happens only under a separate agreement and a reviewed process. That process may include a business associate agreement, a HIPAA-grade de-identification step before any data reaches a buyer, and a review of the original privacy policies and any applicable court or fiduciary process. Some data may not be eligible for sale.

No warranties

The site and its content are provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Magma will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred US dollars.

Intellectual property

The site, its content, and the Magma name and logo belong to Magma. We grant you a limited right to view the site to evaluate a potential engagement, and nothing here transfers any other rights.

Forward-looking statements

Descriptions of capabilities, process, and our network of buyers are general and may change. Please do not rely on them as commitments.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and the state and federal courts located in Harris County, Texas will have jurisdiction.

Changes

We may update these terms. Continued use of the site after an update means you accept the revised terms.
